1. Agreement

These Terms & Conditions govern your use of Growly, a mobile app and related services provided by DMD Ltd. By downloading, accessing, subscribing to, or using Growly, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Growly.

2. The service

Growly provides AI-assisted parenting reflection, onboarding, parenting plans, daily nudges, journaling, optional source references, weekly summaries, widgets, notifications, and subscription-based access to app features.

Growly is designed to support everyday reflection. It is not a medical, therapeutic, diagnostic, emergency, crisis, child-safety monitoring, legal, or professional healthcare service.

3. Eligibility and account use

You must be legally able to agree to these Terms. Growly is intended for parents and caregivers, not for children to use directly. You are responsible for the information you enter and for keeping your device, account, and sign-in method secure.

Growly may support local use before sign-in and optional sign-in with Apple or Google through Firebase Authentication. If you sign in, you authorize Growly to link account-backed app data and subscription entitlement state to your authenticated app identity.

4. Subscriptions, trials, and billing

Some Growly features require a paid subscription. Subscription offerings, prices, free trials, billing periods, and renewal terms are shown in the app store purchase sheet or paywall before purchase.

Purchases are processed by Apple App Store and, when Android launches, may be processed by Google Play. RevenueCat helps Growly manage entitlement status, trial status, purchase restoration, and subscription access.

Subscriptions renew automatically unless canceled through the store account that manages the purchase before the renewal deadline stated by Apple or Google. Deleting the Growly app or deleting your Growly account does not automatically cancel a subscription.

5. Cancellation and restoration

You can cancel an active subscription through your Apple App Store account settings or, when Android is available, through Google Play subscription settings. Growly may provide in-app links for managing subscriptions and restoring purchases, but store cancellation rules are controlled by Apple or Google.

Refund requests are handled by the applicable app store unless otherwise required by law.

6. AI-generated content

Growly may generate AI-assisted coaching responses, summaries, reflections, prompts, and source suggestions. AI-generated content may be incomplete, inaccurate, inappropriate for your situation, or based on limited context. You are responsible for deciding how to use it.

Do not rely on Growly for emergencies, crisis support, diagnosis, treatment, legal decisions, or child-safety monitoring. If you or someone else may be in danger, contact local emergency services or a qualified professional immediately.

7. Acceptable use

You agree not to misuse Growly. This includes not using Growly to:

• break the law or violate another person's rights;
• submit harmful, abusive, exploitative, or unlawful content;
• attempt to reverse engineer, attack, overload, scrape, or interfere with Growly or its backend services;
• misrepresent your identity or subscription status;
• use Growly as an emergency, clinical, legal, or safety-monitoring tool;
• enter information that directly identifies a child unless truly necessary and lawful.

8. Your content

You keep ownership of the reflection notes and other content you enter into Growly. You grant DMD Ltd. the rights needed to operate Growly, including storing, processing, displaying, syncing, backing up, deleting, and generating app responses from that content as described in the Privacy Policy.

9. Growly intellectual property

Growly, including its app design, software, text, graphics, mascot, branding, workflows, and generated app structure, is owned by DMD Ltd. or its licensors. These Terms do not give you ownership of Growly or permission to copy, resell, or create derivative services from Growly except as allowed by law.

10. Third-party services

Growly relies on third-party services such as Firebase, RevenueCat, Apple, Google, and SerpApi for optional source retrieval. Their services may be subject to their own terms and privacy policies. Growly is not responsible for third-party store rules, outages, purchase processing, or platform decisions.

11. Account deletion and termination

You may delete your Growly account from the app where account deletion is available. Account deletion removes the main account-backed Growly records described in the Privacy Policy, but it does not automatically cancel subscriptions managed by Apple or Google.

We may suspend or terminate access if you violate these Terms, create risk for other users or the service, misuse subscriptions, or if we are required to do so by law or platform rules.

12. App availability and changes

We may update, change, suspend, or discontinue parts of Growly at any time. Some features depend on device capabilities, operating system support, Firebase availability, RevenueCat availability, app store availability, AI model availability, permissions, or internet connectivity.

We do not guarantee that Growly will always be available, error-free, or compatible with every device.

13. Disclaimers

Growly is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not promise that Growly will produce any particular parenting outcome, prevent conflict, identify safety risks, or replace professional judgment.

14. Limitation of liability

To the fullest extent permitted by law, DMD Ltd. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from or related to Growly.

Nothing in these Terms limits liability that cannot legally be limited, including mandatory consumer rights that apply where you live.

15. Governing law

These Terms are governed by the laws of Bulgaria, without regard to conflict-of-law rules. If mandatory consumer protection laws in your country of residence give you additional rights, those mandatory rights are not limited by these Terms.

16. Changes to these Terms

We may update these Terms as Growly changes. If changes are material, we will take reasonable steps to notify users, such as updating the effective date, posting the updated Terms, or providing in-app notice where appropriate. Continued use of Growly after updates means you accept the updated Terms.
